Disability employment discrimination is prohibited in the United States by Title I of the
Americans with Disabilities Act of 1990 (ADA). Persons protected from disability employment discrimination include:
- People with disabling conditions that have physical or mental conditions that substantially limit major life activities;
- People with a history of disabilities;
- People who are regarded as having such an impairment.
You might also be wondering right now, "What the heck does it mean that you're regarded as having an impairment? Does that mean if I think I'm disabled then I'm covered?" Um, no. This refers to people who are not disabled but who are viewed by others as being disabled and have faced
discrimination because of it.
In addition, to meeting one or more of the requirements above, a person must also have the qualifications for the job and be capable of performing the job as is or with reasonable accommodations.
