Section 504 Information - Overview of Section 504 of the Rehabilitation Act of 1973

Section 504 of the Rehabilitation Act of 1973was implemented by Congress in 1977. For many years,it was applied in public schools only in terms of physical access to buildings such as wheelchair ramps, elevators, and enlarged doorways.

As part of the Rehabilitation Act of 1973, Congress required that school districts make their programs and activities accessible and usable to all individuals with disabilities.

Over time, the interpretation and application of Section 504 has broadened. The US Department of Education's Office for Civil Rights (OCR) has become active in assisting school districts in further defining what Section 504 actually requires.

Currently, the definition of access means more than just physical access to buildings. It has evolved to include special adaptations and accommodations such as modified assignments, special instruction, assistance with medical needs that impact a child's ability to participate and learn in school. Section 504 continues to evolve through guidance from OCR and establishment of obligations through court case law.
